Terms and Condition

KTreks Inc. (DBA Kosher River Cruises / KRC Expeditions / Kosher X Tours) 

Effective Date:Upon registration, electronic signature, or deposit / payment, the Guest acknowledges and agrees to these Terms and Conditions. 

Parties 

This Agreement is between KTreks Inc. (“Company”) and the individual or entity booking travel services (“Guest”). 

Pricing and Availability 

  • All fares are quoted in U.S. dollars per person, based on double occupancy unless otherwise stated. 
  • Fares are capacity-controlled and subject to change without notice. 
  • Discounts are applied sequentially; fixed savings precede percentage-based discounts. 
  • Stateroom/ hotel room category availability is not guaranteed. 
  • If air travel is purchased through KTreks as part of a cruise/tour package, the total package price is guaranteed upon final payment. 

Reservations and Payments 

  • River Cruises & Land Tours: $1,000 deposit per person; final payment due 150 days before departure. 
  • Ocean Cruises (KRC Expeditions): $2,000 deposit per person; final payment due 180 days before departure. 
  • Antarctica Cruises: $3,000 deposit per person; final payment due 270 days before departure. 
  • Bookings within the stated deadlines require full payment at time of booking. 
  • Airfare booked through KTreks requires full, non-refundable payment at time of booking (refundable within 24 hours only). 

Failure to make timely payments will result in cancellation without refund. 

Exclusions 

Published prices exclude: airfare (unless specified), airport taxes, excess baggage, passport/visa fees, personal expenses, meals not listed in itinerary, optional excursions, and travel insurance. 

Gratuities & Port Fees 

Port fees and gratuities for onboard personnel are included in the final payment. 

Cancellation Policy 

All cancellations must be submitted in writing and are effective upon receipt. No refunds for unused services. 

River Cruises & Land Tours 

  • >180 days: Deposit non-refundable; may be applied to future program. 
  • 180–150 days: 50% retained; remainder may be credited to future program. 
  • <150 days: Non-refundable. 

Ocean Cruises 

  • >360 days: Deposit non-refundable; may be applied to future program. 
  • 360–270 days: 50% retained; remainder may be credited to future program. 
  • <270 days: Non-refundable. 

Airfare is always non-refundable after 24 hours. 

If KTreks cancels due to insufficient participation, all payments made to KTreks will be refunded. KTreks is not liable for additional costs (airfare, hotels, etc.). 

Travel Protection 

Guests are strongly encouraged to purchase travel protection. Details are available on the KTreks insurance webpage. 

Governing Law 

This Agreement shall be governed by and construed under the laws of the state/province where KTreks Inc. is incorporated. 

Deposit Protection Program – Three-Year Guarantee 

If Guest cancels within the timeframes outlined in Section 6 and is eligible for a credit: 

  • Credit may be applied to a future KTreks program of the same category for up to three (3) years from the cancellation date. 
  • Credits have no cash value and are non-transferable; they may only be applied to the original passenger. 
  • Only one credit per person per booking may be applied and is combinable with current KTreks promotions. 
  • Credits cannot be exchanged for refunds and must be used as payment toward a future booking. 

Travel Protection – Insurance 

Travel insurance is strongly recommended. KTreks Travel Protection Plans provide coverage for unforeseen events, including trip interruption, delay, medical expenses, quarantine, and emergency evacuation. 

  • Guests traveling without insurance must acknowledge full responsibility for all expenses arising during travel. 
  • Insurance details and purchase options are available via the link on the KTreks homepage. 
  • Most policies require purchase within 14 days of reservation and deposit to be covered for any pre-existing conditions. 
  • Final travel documents will not be released until Guest completes the insurance acknowledgment section of the Passenger Information Form. 

Credit Card Insurance Disclaimer:Relying solely on credit card insurance is not recommended. Coverage varies and is typically limited compared to dedicated travel insurance policies. 

Payment Options 

  • Deposit & Initial Registration: Deposits may be paid by credit card, check, direct deposit, bank wire, or Secure ACH Direct Deposit. 
  • Final Payment: Final payments must be made by check, direct deposit, bank wire, or Secure ACH Direct Deposit (U.S. banks only). 
  • Upon request, KTreks will provide an ACH authorization form. Guests must complete and return the form via fax, mail, or scanned email for security purposes. 

Arrival & Departure Transfers 

  • Group Transfers: Guests purchasing a KTreks vacation receive scheduled group transfers between designated airports and the ship/hotel on embarkation and disembarkation dates, provided flight arrangements comply with KTreks Transfer Guidelines. 
  • Waiting periods of two hours or more may occur unless private transfers are purchased. 
  • Private Transfers: Available for purchase on embarkation/disembarkation dates only, between designated airports and the ship/hotel. 
  • Maximum two guests per private car; three or more guests require a van or bus. 
  • Independent Flight Arrangements: Guests arranging their own flights may receive complimentary group transfers if flights comply with Transfer Guidelines and details are provided to KTreks at least 45 days prior to departure. 
  • Guests arriving/departing outside these parameters must arrange their own transfers. 
  • KTreks is not responsible for missed transfers, delayed/cancelled flights, missed cruise days, or related costs. 
  • Air Booking Assistance: KTreks does not provide in-house air booking but can refer guests to an external air agent. A ticket issuance fee may apply. 

 

Baggage & Personal Belongings 

  • Guests may bring one (1) suitcase, one (1) carry-on, and one (1) personal item per person onboard ships and motorcoaches. 
  • Airlines may impose additional restrictions and fees for checked or excess baggage. 
  • Guests are responsible for their baggage at all times. KTreks assumes no liability for loss, theft, or damage to baggage or personal belongings during the cruise or transfers. 
  • Supplemental travel protection covering baggage loss or damage is available. 

Check-In & Check-Out 

  • Embarkation: Staterooms available after 3:00 PM. Guests arriving earlier may wait in public areas onboard if available. 
  • Disembarkation: Staterooms must be vacated by 8:00 AM; final check-out by 9:30 AM. Guests with later flights may wait onboard until 1:00 PM, if available subject to sailing schedule. 
  • Hotel stays follow standard check-in/check-out times. Early or late check-ins cannot be guaranteed. 

Mandatory Passenger Registration 

Guests must register via the dedicated tour page link provided on the KTreks website. 

Client Portal & Documentation 

Upon deposit and registration: 

  1. Guests receive confirmation of reservation, invoice, and individual reservation number. 
  1. Guests receive a link to their Client Portal, where they can: 
  • Upload/download required documents. 
  • Submit personal details, emergency contact, and insurance information. 
  • Provide dietary, medical, or special requirements. 
  • Enter flight arrival/departure details. 
  • Communicate with KTreks and process ACH payments securely. 

 

Travel Documents 

  • Provided full payment and registration are completed, electronic travel documents will be available for download 21 days prior to departure via the Guest’s Client Portal or designated website link. 
  • Documents include embarkation details, accommodations, and FAQs. 

 

Passport and Visa Requirements 

  • A valid passport is required for all KTreks programs and must remain valid for at least six (6) months after the scheduled return date. 
  • Guests are responsible for obtaining all required visas and travel documentation. 
  • Non-U.S. citizens must contact the appropriate consular office for entry requirements. 
  • Passport and emergency contact information must be submitted prior to release of travel documents. 
  • Certain itineraries (e.g., Mekong, Amazonas) may require special visas; instructions will be posted in the Client Portal and/or via electronic communication. 
  • Visa services may be available onboard for select departures; payment is made directly to the cruise company. 
  • KTreks assumes no responsibility for advising or obtaining required documentation. 

 

Itinerary Changes 

  • KTreks reserves the right to modify itineraries, vessels, or hotels due to conditions beyond its control (e.g., weather, water levels, operational issues). 
  • Substitutions will be made with comparable alternatives whenever possible. 
  • Changes do not entitle Guests to refunds. Guests who cancel due to itinerary changes are subject to the standard Cancellation Policy. 

 

Advanced, Cancelled, or Delayed Sailing 

  • KTreks may cancel, advance, postpone, or modify departures, itineraries, accommodations, or transportation due to circumstances beyond its control or deemed necessary. 
  • Liability is limited to providing a Future Travel Credit or, at KTreks’ discretion, a refund of monies paid to KTreks for the affected cruise/tour. 
  • KTreks is not responsible for costs related to other travel arrangements (e.g., airfare, hotels). 

 

Stateroom Changes 

  • If a stateroom change is required due to technical or unforeseen circumstances, Guests will receive a refund equal to the fare difference between the original and reassigned category. 

 

Extensions and Land Tours 

  • KTreks may reschedule or cancel land extensions or tours if minimum participation is not met or for safety reasons. 
  • Guest cancellations are subject to the standard Cancellation Policy. 

 

Security 

  • Global security conditions may require itinerary changes or cancellations. Guests assume all risks associated with travel decisions. 

 

Personal Responsibility – COVID-19 

  • Guests voluntarily assume all risks related to COVID-19 exposure. 
  • Guests must follow health and safety protocols, including physical distancing and hygiene practices. 
  • Non-compliance with safety protocols will result in removal from the program at Guest’s expense. 

 

Code of Conduct 

  • By paying a deposit or signing the Terms and Conditions, Guests agree to comply with all safety protocols and onboard behavior standards. Failure to comply will result in immediate removal at Guest’s expense. 

Land Touring 

  • Guests must remain with the group during all land tours. 
  • If a Guest chooses to separate from the group (e.g., for shopping or sightseeing), they must inform the tour leader and agree to return to the ship or bus at the designated time. 
  • Failure to return on time is the Guest’s responsibility. The ship will not delay departure for late arrivals. 
  • Guests who miss a departure must arrange and pay for transportation to the next port of call. 

Guest Behavior 

  • Guests must treat fellow passengers, KTreks staff, and ship personnel with dignity and respect. 
  • Physical or verbal abuse will not be tolerated. Guests engaging in such behavior will be removed from the cruise at their own expense. 

Acceptance of Code of Conduct 

  • Payment of deposit and/or signature of the KTreks E-Sign Terms and Conditions constitutes acknowledgment and acceptance of this Code of Conduct as a legally binding agreement. 

 

Health and Mobility 

  • Guests must disclose any physical, medical, or special needs at the time of booking or as soon as such needs arise. 
  • Guests must ensure they are medically and physically fit for travel. 
  • KTreks may impose safety requirements or exclude individuals whose participation poses a direct health or safety threat. 
  • KTreks does not provide personal devices (wheelchairs, hearing aids, etc.) or personal assistance (eating, toileting, dressing). Guests requiring such assistance must travel with a capable companion. 
  • KTreks does not employ medical personnel; any medical care will be provided by local facilities at the Guest’s expense. 
  • Some tours involve rough terrain, stairs, and locations that may not be wheelchair accessible. Accessibility cannot be guaranteed. 
  • KTreks may decline or terminate a booking if a Guest cannot comply with these terms. Guests agree not to hold KTreks liable for actions taken under these conditions. 

 

Young Travelers 

  • Minimum age: 7 years.  Custom tours and charters no age minimum. 
  • Guests under 18 years must be accompanied by a parent or guardian and share a cabin with someone 21 years or older. 
  • Adults accompanying minors are responsible for their safety and behavior. 

 

Smoking Policy 

  • Smoking is permitted only in designated areas on the ship. 
  • Smoking is prohibited inside ships and on motorcoaches. 
  • This policy applies to all smoking materials, including e-cigarettes and vaporizers. 

 

Dietary & Special Requirements 

  • Clients requiring special accommodations (including but not limited to dietary needs, mobility assistance, or specific travel arrangements) are obligated to notify and obtain written confirmation from KTreks prior to booking. KTreks shall have no liability for any failure to accommodate requests that were not confirmed in writing before booking. 
  • If a client fails to comply with this requirement and subsequently cancels due to unmet special requests, such cancellation shall be deemed voluntary and will be subject to the cancellation terms and conditions set forth in the booking and tour contract, as agreed upon by the client through electronic signature and payment of deposit. 
  • Special requirements post booking cannot be guaranteed. 

 

Pets 

  • Pets are not permitted on any KTreks program. 

 

Legal Notes 

Attorney Fee Provision 

  • This Agreement is deemed entered into in Seattle, Washington, USA. 
  • The exclusive venue for any action concerning interpretation, enforcement, or breach of these Terms and Conditions, or any grievance relating to the cruise/tour, shall be Superior Court of Washington, King County. 
  • This Agreement shall be construed under the internal laws of Washington, without regard to conflict-of-law principles. 
  • All Guest claims must be submitted in writing and received by KTreks within 60 days after completion of the vacation. Claims not submitted within this period are deemed waived and barred. 
  • In any legal action, arbitration, or proceeding to enforce or interpret this Agreement, the prevailing party shall be entitled to recover reasonable attorneys’ fees, costs, and expenses. 

Responsibility and Waiver 

  • KTreks Inc. acts solely as a promoter and seller of tour programs and does not own or operate any vessels, transportation, or accommodations. 
  • All such services are provided by independent suppliers (“Suppliers”), over whom KTreks has no control. 
  • KTreks assumes no liability for acts or omissions of Suppliers, including cancellations, delays, rerouting, equipment failures, accidents, injuries, death, or property loss. 
  • Guests agree to seek recourse solely from Suppliers for any claims arising from accidents, injuries, or losses. 
  • Guests acknowledge and accept all risks associated with travel, including but not limited to: 
  • Hazards of undeveloped areas 
  • Transportation by various means 
  • Political unrest, differing safety standards, and sanitation 
  • Illness or injury in areas lacking medical facilities 
  • Guests voluntarily assume all risks and agree not to hold KTreks liable for any loss, injury, or damage. 
  • This release applies to Guests, their families, minors, heirs, and assigns. 

 

Omissions 

  • KTreks is not responsible for errors or omissions in brochures, websites, or other media. 
  • KTreks reserves the right to correct such errors as needed. 

 

Agreement 

  • Payment of deposit and/or issuance of tickets constitutes consent to these Terms and Conditions. 
  • Guests must complete and sign the emailed E-Sign Cruise Contract / Terms and Conditions form / contract within 14 days of initial deposit or reservation, or booking is subject to cancellation. 
  • This Agreement is entered into in King County, Washington, and any legal action shall be brought exclusively in Superior Court of Washington, King County. 
  • This Agreement shall be governed by Washington law. 

Time of Publishing 

  • These Terms and Conditions are effective at the time of publication and remain in effect until replaced. They supersede all prior versions. 

Knowing and Voluntary Execution 

  • Guests acknowledge they have read and understand these Terms and Conditions, including cancellation policies, liability limitations, Code of Conduct, and insurance requirements. 
  • By paying a deposit / completing registration, Guests agree to these Terms as a legally binding contract. 

Required Signature 

  • Within 14 days of registration, Guests will receive a E-Document Sign link to complete cruise / tour contract with electronic signature.  Guess have the option to sign a physical copy of the tour contract upon request. 
  • All participants 18 years and older must sign. 
  • A parent’s signature covers minors under 18. 

 

KTreks Inc. Travel Protection Plan & Requirements 

Insurance Requirement 

  • Travel insurance is strongly recommended for all Guests. 
  • Guests traveling without insurance acknowledge and agree, by registering with a deposit and/or signing the KTreks Terms and Conditions, to assume full responsibility for all expenses arising from: 
  • Trip interruption or delay 
  • Medical expenses 
  • Quarantine costs 
  • Emergency evacuation or repatriation 

Mandatory Insurance Coverage 

For cruise and tour programs where travel insurance is required, Guests must provide written proof of coverage to KTreks Inc. no later than 90 days prior to departure. Failure to submit proof of insurance by this deadline will result in cancellation of the reservation, and all monies paid toward the cruise or tour program will be forfeited. It is the Guest’s responsibility to obtain the necessary travel insurance with the appropriate coverage as outlined in the tour materials. 

 

Recommended Provider 

  • KTreks recommends Trip Mate Insurance, offering comprehensive coverage at competitive rates, available for purchase via the Kosher River Cruise Website. 
  • Coverage is available only to U.S. residents. Guests residing outside the U.S. may purchase insurance from a provider in their home country. 

 

Purchase Guidelines 

  • Travel protection plans can be viewed and purchased via the KTreks program website. 
  • Most insurance policies require purchase within 14 days of reservation and deposit to cover any preexisting conditions. 
  • Guests may also purchase insurance from any provider of their choice. 

 

Guest Responsibility 

  • Any additional costs associated with trip delay, cancellation, medical care, or baggage loss are the sole financial responsibility of the Guest if insurance is not purchased.

  • Sickness and medical expenses

  • Trip cost default protection 
  • Travel accident coverage 
  • Baggage and personal effects/lost luggage 
  • Flight insurance 
  • Trip delay 
  • Major medical coverage 
  • Additional benefits as outlined by the insurer

Photography  

Photography and Likeness Release 

  • By participating in any KTreks Inc. cruise, tour, or related program, Guest grants KTreks Inc., its affiliates, and authorized representatives the irrevocable right and permission to photograph, film, record, and otherwise capture the Guest’s image, likeness, voice, and statements during the program. Guest agrees that such photographs, videos, and recordings may be used, reproduced, and published by KTreks Inc. for any lawful purpose, including but not limited to advertising, marketing, promotional materials, social media, and website content, without compensation or further approval. Guest waives any right to inspect or approve the finished product or any use thereof. This release applies worldwide and in perpetuity. 

Opt-Out of Photography and Recording 

  • Guests who do not wish to have their image, likeness, or voice captured in photographs, videos, or recordings for promotional purposes must notify KTreks Inc. in writing prior to the start of the program and inform the tour leader upon arrival. While KTreks will make reasonable efforts to accommodate such requests, Guests acknowledge that complete exclusion from all group photography or incidental recordings cannot be guaranteed in public or group settings. 

Knowing & Voluntary Execution; Required Signature 

  • By registering, signature / or E-signature and payment of deposit guest confirms understanding and acceptance of cancellation/refund policies, limitation of liability, Code of Conduct, insurance requirements, and all terms herein. 
  • E-Sign Required: Within 14 days of registration/reservation, Guest must execute the E-Sign agreement. All participants 18+must sign; a parent’s signature covers minors under 18.

Standard Contract Provisions 

  • Force Majeure: KTreks is not liable for failure/delay due to events beyond reasonable control (e.g., acts of God, weather, war, terrorism, epidemics/pandemics, government actions, labor disputes, power outages, vessel/transport mechanical issues). 
  • Severability: If any provision is invalid/unenforceable, remaining provisions remain in effect. 
  • Assignment: Guest may not assign this Agreement; KTreks may assign to an affiliate/successor. 
  • Entire Agreement: This Agreement (including referenced policies and Supplier terms) is the entire agreement and supersedes prior statements. 
  • Amendments: Changes must be in writing and authorized by KTreks. 
  • Electronic Signatures: E-signatures (including DocuSign) are valid and enforceable. 
  • Notices: Communications to KTreks must be in writing and sent via the Client Portal, email, fax, or mail to the address provided in your confirmation.
